It is against the law to sell or supply alcohol to anyone under 18 years of age in the UK. By placing an order you confirm that you are at least 18 years old.

Our Contract With You

A contract of any kind between you and us will not start until we accept your order and, in the case of wines and goods to be delivered to you, when goods are dispatched to you. At any point up until then, we may decline to supply the goods or services to you without giving any reason. At the moment we accept your order or in the case of delivery of goods, when the goods are despatched, a contract will be made between you and us.

If we are unable to accept your order, we will inform you of this and will not charge you for the goods. This might be because certain goods are out of stock, because a credit reference we have obtained for you does not meet our minimum requirements, because we have identified an error in the price or description of the goods or because we are unable to meet a delivery deadline you have specified.

Description & Prices

Products offered by us are displayed on our website(s) in 'real time', meaning any product may be withdrawn from offer without notice. The description and prices payable for the items or services that you order are set out in our emails, price list, brochure and/or website. If, by mistake, we have underpriced an item or service, we will not be liable to provide that item to you at the stated price if we notify you before we despatch the item concerned. If we are not despatching an item, within 7 working days of our acceptance of your order and we may cancel your order and refund you any payments you have made. You may agree to pay the correct price in which case we will proceed with your order. 

Unless displayed In Bond, prices listed for wines online are quoted per bottle and per case, and include duty and VAT at the current rate. We reserve the right to change our prices. Please refer to our website for all current prices. 

Prices are subject to currency and market fluctuations, changes in duty and VAT as well as stock remaining unsold. If any other currency is stated, this is subject to currency fluctuations and is an indication only.

Delivery

Delivery is free for orders over £200 to a single UK mainland address. All other orders are charged £18.00 per UK mainland address (excluding delivery charge and/or purchases of tasting tickets, gift vouchers and wines bought en primeur or in bond). 

Deliveries to Northern Ireland, Jersey, Channel Islands, The Isle of Man, The Isle of Wight, The Scilly Isles and some areas of Scotland may take longer and are subject to a surcharge. We can also deliver outside the UK. Please contact us via info@petershamcellar.com to get a quote.

We reserve the right to charge for re-delivery of orders that have not been completed due to incorrect address information being supplied by the customer or where the customer is not available or not present to take receipt of the delivery.
Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.

Receipt of Goods

Deliveries should be signed for as ‘Not Examined’ and you should inspect the goods as soon as possible and notify us immediately of breakages or wine shortages. We must be informed of this within 3 working days of receipt. We will arrange a collection of these products sent in error as necessary once we have investigated the dispatch records for your order. 

Please be aware that multi-case orders can become separated. If you do not receive the balance of your order within 3 working days of the first delivery, please contact us. If you will not be at the delivery address at the time of delivery and wish us to leave your order in a safe place, please advise us. We regret that neither we nor our carriers can accept responsibility for any subsequent loss or damage which occurs once the consignment has been left. Return of Goods/Cancellation

Orders for goods to be delivered, excluding pre-landing offer (En Primeur and Anteprima), may be cancelled within 7 working days of receipt of goods. A full refund will be offered provided the goods remain in good condition and that the request to cancel is received in writing. You can tell us you want to cancel your order by emailing us at info@petershamcellar.com. Any cancelled order will be refunded as soon as possible, usually within 10 days. 

Unwanted items must be returned and received by us within 14 working days after the day of the date that the item was delivered to you. Please note the customer will be liable for the amount payable to return the product and appropriate repackaging required. We strongly recommend using an insured and recorded delivery service to the full value of the goods. 

All returned items must be in their original packaging, in an untampered, re-saleable condition. Due to the nature of the goods, refunds will not be issued where there are clear signs of tampering rendering the goods not resaleable. If returned wines are not deemed to be in a saleable condition, a re-delivery fee will also be charged. Promotional products that are added/included at no extra charge cannot be refunded if damaged or replaced without a subsequent postage charge being applied subject to availability.

We are only able to accept returned gifts and arrange refunds where this is sought by the purchaser with evidence of the relevant sales. The item must be returned to our LCB warehouse in Tilbury. We are not able to exchange gifts on request of the recipient of the gift, except for reasons of quality control. We are unable to offer credit to the recipient of the gift. 

Gift Vouchers

Gift vouchers may be redeemed online, via email at info@peterhsmacellar.com or phone at 0207 183 7570. They are single use and only apply for goods listed on our website, cannot be exchanged for cash or credit and cannot be used to discharge indebtedness on previous orders or in respect of accounts held at Petersham Cellar.

Faulty bottle

We are committed to providing our customers with the highest level of service. If a wine is corked or faulty, we will, in the first instance, offer a replacement bottle; or if we are unable to replace the bottle from our stocks, we will offer a credit to the replacement value of the wine.

We must be notified of damaged or faulty products within 3 working days of receipt. We may require the faulty products to be returned to us so please keep all the original packing. In order to process a refund or replacement due to damage or breakage, a clear photograph(s) of the damaged goods will need to be provided.

Please note if a wine has been kept for too long or stored inappropriately, we may not be able to offer a refund. If you believe a wine to be faulty please contact us via email at info@petershamcellar.com or phone at 0207 183 7570 and we will be happy to make arrangements to have the wine collected and tested.

Promotional Vouchers and Offers

Unless specified otherwise, promotional vouchers cannot be used in conjunction with any other promotions or offers. Promotional vouchers are single use and only apply to specific products and may not be used to purchase events, En Primeur or other Fine Wines or as payment for Duty and VAT on wines. They only apply for goods listed on our website, cannot be exchanged for cash or credit and cannot be used to discharge indebtedness on previous orders or in respect of accounts held at Petersham Cellar.

Sales & Return

All sale or return orders must be arranged in advance either through your account manager or by contacting our customer service team. They must include a minimum of £300 of wine, Champagne, Port or spirits. The customer will be responsible for returning the goods. A maximum of 20% of the original order quantity can be returned. All returned goods must be in re-saleable condition otherwise no credit will be given. 

Substitutes/availability

All wines and spirits and other goods are subject to availability. When selecting the wines or other goods from our price list we try to ensure that they will remain available throughout the life of the list. However, some items will inevitably go out of stock and we therefore reserve the right to select and deliver to you a substitute (of equal or higher value) to the wine you have ordered, to avoid delay in the delivery of orders. If we are unable to supply a particular item, or do not supply a substitute, we will not be liable to you except to ensure that you are not charged for that item.

Events Policy

All attendees of Petersham Cellar ticketed events must be 18 years or older. In line with the Company’s age verification policy and to comply with UK licencing law, attendees may be asked to produce photographic identification with proof of age. If you are not able to do so, you may be refused entry.

In the event of cancellation by the Customer, full refunds will only be given if we are notified at least 7 days before the date of the event. Refunds will only be given after this time if we are able to re-sell your tickets. Credits will be given if we are notified less than 7 days before the date of the event.

En Primeur & Other Pre-landing Offers 

Also known as Wine Futures, En Primeur refers to the process of buying wines before they are bottled and released onto the market. Wines are usually delivered 2-3 years after the vintage and can only be purchased as a full case. All Pre-landing orders are placed ‘in bond’ which excludes duty and VAT but includes the cost of shipping to the UK. Please note prices may vary due to fluctuations in currency and the market and to stock not being sold. For this reason, special conditions supplement the basic terms and conditions and, where applicable, supersede them.

Petersham Cellar will use its best endeavours to offer wines in quantities for which it has placed confirmed orders. However, because En Primeur is offered initially as a "future", we cannot guarantee availability until it is delivered to our warehouse in the UK and available for delivery. In the event a wine is unavailable for reasons beyond our control, the initial payment which will be refunded in full. Please note this is the only liability from Petersham Cellar to you when buying en-primeur and anteprima.

For En Primeur and other pre-landing order, customers will be invoiced and will have to pay the opening price. Wines ordered through our en primeur service can only be cancelled within 7 days of placing the order. Notice must be given in writing and will be effective upon receipt at Petersham Cellar head office. A full refund of the purchase price of the wines will be given on receipt of formal notification for the cancellation of the order. Due to the unique nature of en primeur and pre-landing sales, we regret that orders cannot be cancelled after this time.

Once the wine lands in the UK, the cases are held initially in our bonded warehouse. By default, wines will be entered directly in to your Private Reserves in bond. Once the wines are in your Private Reserves, we will notify you by email and offer three options:
•    Customers can either pay the prevailing rate of duty, VAT and onward delivery to have the wines despatched to their home (view current duty rates). If you want to withdraw part of a case, there is an additional charge of £10 (inc. VAT, where applicable) per product. 
•    Customers may request a transfer to their bonded warehouse. Please note transfer fees apply. To UK IB warehouse the fee is £15 + VAT per single case with a minimum of £30 + VAT per transfer.
•    Alternatively, the wine will be cellared in Petersham Cellar wine storage facility, with an annual fee (currently £?? per case per year). On arrival, wines purchased En Primeur or as a pre-landing offer will continue to be stored In Bond unless we receive written instructions to the contrary. 

On receipt of this email, or the subsequent invoice for rent, should you wish to take delivery, any rent charged on wines withdrawn within 30 days of the date of invoice for rent will be credited.

However, because En Primeur is offered initially as a "future", we cannot guarantee availability until it is delivered to our warehouse in the UK and available for delivery. In the event a wine is unavailable for reasons beyond our control, the initial payment which will be refunded in full. We will remain responsible for insuring the wine at the original invoice value until your delivery and/or storage instructions have been completed. Ownership of the wines will pass on settlement of all outstanding charges.

Payment

When you give Petersham Cellar your credit or debit card details you are confirming that you are either the card holder, or that you have permission from the card holder to use the card for the purpose of ordering wine. View our security policy.

Data Collection

We collect information about our customers to provide the best level of service possible and inform about the latest releases, special offers and events. We take your privacy very seriously and will only pass your details on to 3rd parties when necessary to fulfil your order (i.e. warehouse operators, carriers etc). View our privacy policy.

Membership

From your first order, you will be automatically enrolled in our membership. Every year, we will review your membership and may offer alternative. We reserve the rights to amend our reward lists, pending availability, and benefit levels at any time and to cancel your membership at any time.
